Official insertTableOfContents example throws XMLStreamException: No open start element- when trying to write end element

I am using the example code provided in the JavaDoc of DocumentBuilder
to write a document with TOC:

I am then saving the document in different formats, docx and pdf are
ok, however when trying odt I get:

XMLStreamException: No open start element, when trying to write end element

Does anybody else having troubles to write TOC for odt documents?

I have tested the scenario and have managed to reproduce the same issue at my side. For the sake of correction, I have logged this problem in our issue tracking system as WORDSNET-9871.
